2. SpeechThrive is a Technology Platform, Not a Healthcare Provider

SpeechThrive is a technology platform that connects Patients with independent Speech-Language Pathologists (SLPs). We provide the technical infrastructure that enables SLPs to deliver their services remotely.

• Passive Intermediary: We do not control, direct, or supervise the clinical practice of any SLP. We are a passive intermediary under the Information Technology Act, 2000.
• Independent Professionals: All SLPs on our Platform are independent professionals. They are not employees, agents, or representatives of SpeechThrive.
• No Endorsement: We do not endorse or recommend any specific SLP. You are responsible for choosing your SLP and evaluating their qualifications.

3. No Warranty

The Platform, including all content, features, and tools, is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind.

• We do not warrant that the Platform will be uninterrupted, error-free, or secure.
• We do not warrant the accuracy, completeness, or reliability of any content on the Platform.
• We do not warrant the qualifications, competence, or performance of any SLP on the Platform.
• We do not warrant that the Platform will meet your specific requirements or expectations.

4. Third-Party Tools & Services

SpeechThrive integrates with third-party tools and services, including:

• Microsoft Azure Speech API: Used for speech analysis. The results are generated by Azure and are provided as a reference tool only. We do not guarantee the accuracy or reliability of Azure's results.
• Cloud Hosting Providers: We use third-party cloud services to store and process data. While we select reputable providers, we cannot guarantee their security or reliability.
• Video Conferencing: We may integrate with third-party video conferencing tools for online sessions. Those tools are governed by their own terms and privacy policies.

5. Limitation of Liability

⚠️ IMPORTANT LIMITATION:

To the maximum extent permitted by law, Aitude Technologies (SpeechThrive) shall NOT be liable for any:

✖ Medical Outcomes: Any clinical outcomes, including misdiagnosis, improper treatment, or any adverse events arising from services provided by SLPs on our Platform.
✖ SLP Conduct: Any negligence, misconduct, or malpractice by any SLP on our Platform.
✖ Data Breaches: Unauthorized access to your data caused by factors beyond our reasonable control.
✖ Indirect Damages: Any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.
✖ Third-Party Tools: Any issues arising from third-party tools integrated into the Platform, including Azure Speech API.
✖ Payment Disputes: Any disputes regarding payments, fees, or refunds between Patients and SLPs.

📌 Total Liability: Our total liability to you, for any claim arising out of or relating to the Platform, shall not exceed the total amount of platform fees paid by you (if any) during the 12 months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Aitude Technologies, its directors, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Platform;
• Your violation of any law, regulation, or these terms;
• Any Content you upload or share through the Platform;
• Any claims made by your Patients or SLPs arising from your use of the Platform.

7. No Guarantee of Results

SpeechThrive does not guarantee any specific results or outcomes from using the Platform. The effectiveness of speech therapy depends on many factors, including the Patient's condition, the SLP's expertise, and the Patient's engagement. Any testimonials or success stories shared on the Platform are individual experiences and do not represent guaranteed outcomes.

Our Platform may contain links to third-party websites or resources. These links are provided for convenience only and do not constitute an endorsement. We are not responsible for the content, accuracy, or practices of any third-party websites. Your use of third-party websites is at your own risk and subject to their terms and policies.
